Welcome to Respond: OCD Tracker. These Terms and Conditions ("Terms") govern your use of our mobile application. Please read them carefully before using our app.

1. About Our Service

Respond: OCD Tracker is a mobile application developed by Haley Oy, a company registered in Finland. Our app is designed to help individuals track their OCD symptoms and recovery progress through a simple, private tracking system.

The app provides:

  • OCD symptom tracking and logging
  • Progress statistics and insights
  • Educational content about OCD recovery
  • Local data storage on your device

All data is stored locally on your device. We do not require account creation or collect personal information.

2. Acceptance and Age Requirements

By downloading, installing, or using Respond: OCD Tracker, you agree to be bound by these Terms and all applicable laws.

Age Requirements:

  • You must be at least 13 years old to use this app
  • If you are under 18, you must have parental consent to use this app
  • If you are a parent or guardian, you are responsible for your minor child's use of the app

If you do not agree to these Terms or do not meet the age requirements, you must not use the app.

3. Subscription and Payments

Respond: OCD Tracker operates on a subscription model with the following options:

  • Monthly subscription
  • Yearly subscription (includes 2-week free trial)

All purchases and subscriptions are processed through Apple's App Store. Payment will be charged to your Apple ID account upon confirmation of purchase.

Subscriptions and Billing:

  • Subscriptions automatically renew unless cancelled at least 24 hours before the current period ends
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage and cancel subscriptions through your Apple ID account settings or manage your subscriptions here

Refunds: All purchases are processed by Apple and subject to Apple's refund policy. EU consumers have additional rights under applicable consumer protection laws, which Apple handles in accordance with EU regulations.

4. Permitted Use

Respond: OCD Tracker is designed specifically for OCD symptom tracking and recovery support. You agree to use the app only for its intended purpose:

  • Personal tracking of OCD symptoms and recovery progress
  • Accessing educational content related to OCD
  • Reviewing your personal statistics and insights

You may NOT use the app:

  • To share or distribute your data to third parties
  • To reverse engineer, copy, or redistribute our content
  • In any way that violates applicable laws

5. App Usage and Conduct

You agree to use Respond: OCD Tracker responsibly and in accordance with these Terms. You agree not to:

  • Misuse or attempt to interfere with the functioning of the app
  • Use the app in any way that could damage, disable, or impair the service
  • Attempt to gain unauthorized access to any part of the app or its systems
  • Use the app for any unlawful purpose or in violation of these Terms

6. Intellectual Property

All content in Respond: OCD Tracker, including but not limited to text, graphics, user interface, educational materials, and software, is owned by Haley Oy and protected by intellectual property laws.

Your subscription grants you a limited, non-exclusive, non-transferable license to use the app for personal use only. You may not:

  • Copy, modify, or distribute our content
  • Create derivative works based on our content
  • Use our content for commercial purposes
  • Remove or alter any copyright or proprietary notices

7. Medical Disclaimers and Limitations

IMPORTANT: Respond: OCD Tracker is a support tool only and is NOT a medical treatment, therapy, or medical advice.

Key Limitations:

  • This app does not replace professional therapy, medical treatment, or mental health care
  • We do not guarantee any specific results or outcomes from using the app
  • The app is not suitable for emergency situations or acute mental health crises
  • Always consult with qualified healthcare professionals regarding your mental health

Emergency Situations: If you are experiencing a mental health emergency or crisis, immediately contact your local emergency services, go to the nearest emergency room, or contact a mental health crisis helpline. Do not rely on this app for emergency support.

By using this app, you acknowledge that you understand these limitations and agree to use the app as a supplementary tool alongside, not instead of, professional mental health care.

8. Privacy and Data Protection

Your privacy is important to us. All data collection, processing, and protection practices are detailed in our separate Privacy Policy, which is incorporated into these Terms by reference.

Key points:

  • All your data is stored locally on your device
  • We do not collect or access your personal data
  • We comply with GDPR and applicable data protection laws
  • You control your data entirely

9. Liability Limitations

To the fullest extent permitted by law, Haley Oy's total liability to you for any claims arising from your use of Respond: OCD Tracker is limited to the amount you have paid for your subscription in the 12 months preceding the claim.

Excluded Damages: We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

Legal Exceptions: These limitations do not apply to liability that cannot be excluded under applicable law, including liability for death, personal injury, or fraudulent misrepresentation.

EU Consumer Rights: If you are an EU consumer, your statutory rights under applicable consumer protection laws are not affected by these limitations.

10. Dispute Resolution

Governing Law: These Terms are governed by the laws of Finland, except where mandatory consumer protection laws in your country of residence provide otherwise. In such cases, your local laws will apply, and you may bring proceedings in your local courts.

Jurisdiction: Finnish courts have jurisdiction over any disputes arising from these Terms or your use of the app, subject to the governing law provisions above.

Alternative Dispute Resolution: Before initiating court proceedings, we encourage resolving disputes through mediation or arbitration, which may be faster and less expensive. However, this is optional and does not prevent you from pursuing your rights in court.

EU Consumer Rights: EU consumers retain their rights under applicable consumer protection laws, including the right to bring proceedings in their country of residence.

11. Termination

Your Rights: You may stop using the app and cancel your subscription at any time through your Apple ID account settings.

Our Rights: We may terminate or suspend your access to the app if you violate these Terms, though this is unlikely given the nature of our local-data app.

Effect of Termination: Upon termination, your right to use the app ends immediately. Since all data is stored locally on your device, you retain access to your data unless you delete the app.

12. Accessibility and Inclusion

We are committed to providing an inclusive, respectful service to all users. However, this app is not a substitute for professional clinical judgment, cultural competence, or individualized accessibility needs. The app does not discriminate based on disability, gender, or background.

13. General Provisions

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Haley Oy regarding the app.

Apple Standard EULA: If you downloaded the app through the Apple App Store, your use is also subject to Apple’s Standard End User License Agreement (EULA).
